According to the Ha Noi People's Court verdict, issued on April 4, 2011, Cu Huy Ha Vu, was accused of "conducting propaganda against the State of the Socialist Republic of Viet Nam" pursuant to Article 88, Item 1, point c of the Penal Code.

During his first trial Cu Huy Ha Vu was sentenced to seven years imprisonment (from his arrest on November 5, 2010) and a three-year of probation in his residential area.

According to the court's verdict, from 2009 until October 2010, Cu Huy Ha Vu had posted many writings and interviews on the Internet containing content distorting Party and State policies, defaming government and State institutions and blackening Viet Nam's resistance war.

The defendant was accordingly charged with "conducting propaganda against the State of the Socialist Republic of Viet Nam".

Following the trial, Cu Huy Ha Vu appealed to the Supreme People's Court to reconsider the verdict.
