VietNamNet Bridge – The Ministry of Justice has confirmed that there is not any regulation that allows provincial People’s Councils to deprive or prevent legal interests of citizens.





The statement has been made after the Ministry carefully checked the Law on Organization of People’s Council and People’s Committee, the Law on Issuance of Legal Documents and the Residence Law.

The Ministry has said that the law, ratified by the National Assembly must be executed seriously and consistently on a nation-wide scale. Only the National Assembly has the right to decide canceling the effect of a law.

According to the Justice Ministry, the Law on Residence was issued after the Law on Organization of People’s Council and People’s Committee, with specific regulations on different subjects, conditions, etc. This law must take effect and Da nang cannot cite the Law on Organization of People’s Council and People’s Committee to issue regulations that are contrary to the Law on Residence.

The ministry has asked the authorities of Da nang city to cancel its measures to restrict immigrants.

Last December, the People’s Council of Da nang approved a resolution that hinders immigrants into the city.

According to the resolution, immigrants will not be given permanent residence status. However, they can still register as temporary residents.

According to Da Nang’s officials, immigration has caused an overload in the city in recent years, because immigrants mainly live in the center. Immigrants have also caused many social and security problems because many of them are jobless and do not have stable accommodations. The city authorities, therefore, have to review and address the immigration management task.

They also said that management of rental houses is loose. The living standards of most immigrants are not ensured. A tightened control over immigrants is needed.

Da Nang’s Party Secretary Nguyen Ba Thanh also said that control of immigrants must be implemented immediately, not until Da Nang is severely overloaded like other big cities in Vietnam.

Da Nang’s Chairman Van Huu Chien said that the number of immigrants in Da Nang has soared recently, only after Binh Duong province and HCM City. At present, there are up to 11,356 immigrant families, totaling 14,290 people, accounting for 11.5 percent of the city’s population.

The resolution became a hot topic. Many people said that Da Nang has broken the law when banning immigrants.

Some agencies under the National Assembly and the government had also raised their voice against Da Nang’s decision.
