Josephine Choy, Netflix's Vice President of Public Policy for Asia-Pacific, said she hoped the Ministry of Information and Communications and related ministries in Vietnam would assist Netflix in completing  procedures for establishing a representative legal entity in Vietnam. She spoke during a recent meeting with Deputy Minister of Information and Communications Nguyen Thanh Lam.

At the meeting, Ms. Choy said that Netflix is carrying out procedures with the Ministry of Planning and Investment to establish its representative legal entity in Vietnam. 

The move is to comply with the provisions of Decree 71 of the Vietnamese Government on the management, provision and use of radio and television services.

Decree 71 stipulates that foreign enterprises participating in the pay TV market in Vietnam with a type of OTT service must be licensed as domestic businesses, so they have to form a legal entity in Vietnam.

Deputy Minister Nguyen Thanh Lam said the Ministry of Information and Communications will support Netflix and other foreign businesses on an appropriate basis and in compliance with Vietnamese laws.

Appreciating Netflix's capacity, Deputy Minister Nguyen Thanh Lam said that Netflix, with its technical potential and content creation, through cooperation with Vietnamese content producers, will contribute to promoting the development of Vietnam's film and digital content industry.

Netflix is a major entertainment service globally, with more than 222 million paid subscribers in more than 190 countries and territories.

Decree 71 amending and supplementing articles of Decree 06 2016 on management, provision and use of radio and television services took effect on January 1, 2023. 

According to the Ministry of Information and Communications, this Decree conveys the message from the Vietnamese Government that the management of the radio and television sector is on the same legal ground for both domestic and foreign enterprises providing cross-border services in Vietnam.
