The newly effective Decree 147 aims to create a level playing field and enhance transparency in the management of Internet resources, including fair regulations for .VN and international domain names.
Decree 147 on the management, provision, and use of Internet services and online information officially came into effect on December 25, 2024.
A key aspect of this decree is its detailed guidelines on policies set forth in the Telecommunications Law of 2023, particularly in the areas of Internet resource management, domain name registration and maintenance services, and the operation of the Vietnam National Internet Exchange (VNIX).
According to Tran Thi Thu Hien, Deputy Director of the Vietnam Internet Network Information Center (VNNIC) under the Ministry of Information and Communications, the decree introduces comprehensive and synchronized regulations for domain name registration and usage. It outlines the conditions, rights, and obligations of service providers in alignment with current realities.
The decree also ensures compliance with the Law on Investment regarding conditional business activities, establishing equitable rules for both .VN and international domain names.
Strengthening legal frameworks for Internet resources
Deputy Director Tran Thi Thu Hien emphasized that the decree standardizes and elevates regulations on Internet resources, ensuring equal treatment for .VN and international domains. These changes incorporate best practices for domain name protection into the decree.
The provisions in Decree 147 address issues and challenges that arose from implementing Decree 72 in 2013, reflecting advancements in digital technology and Internet resource management. They also provide a legal foundation for promoting healthy competition among domestic and international service providers, fostering digital transformation in Vietnam in a secure and sustainable manner.
The decree includes mechanisms for waiving or reducing registration fees to encourage individuals and businesses to establish their online presence and build their brands using .VN domain names. It also updates regulations for resolving disputes over .VN domain names, aligning with international standards such as those established by ICANN and agreements like the Comprehensive and Progressive Agreement for Trans-Pacific Partnership (CPTPP).
Improving user convenience and advancing IPv6 technology
Decree 147 aims to simplify administrative procedures, digitalize registration processes, and promote the adoption of IPv6 technology. These measures are intended to make Internet resource management more accessible for individuals, businesses, and organizations.
According to VNNIC, the decree benefits not only state management but also individuals and service providers. It ensures that individuals and organizations can freely choose Internet resources to register and clearly identify service providers while safeguarding their legitimate rights during registration and usage.
For businesses offering domain registration and maintenance services, the decree creates a competitive and fair business environment, including oversight of cross-border services.
Promoting policy awareness and technical innovation
To ensure that Decree 147 is implemented effectively, VNNIC has emphasized policy communication. In addition to participating in Ministry-led conferences to disseminate the decree, VNNIC has provided guidance to enterprises, enabling them to understand and comply with new regulations.
Training, workshops, and legal education programs for domain service providers will continue to be a priority. VNNIC also plans to adopt innovative measures to improve Internet resource management based on current successful practices.
"By creating a safe and healthy Internet environment, VNNIC aims to accelerate digital transformation and incorporate new technologies to upgrade technical systems, simplifying processes for users while strengthening state management capabilities," Tran Thi Thu Hien stated.
