The government has issued Decree 147/2024/NĐ-CP to regulate the management, provision, and use of internet and online information services.

Speaking about the decree, Tran The Phuong, Deputy Head of the Policy Department at the Authority of Telecommunications (Ministry of Information and Communications), emphasized the obligations of businesses providing mobile network-based content services.

These services are defined as information provided by organizations or businesses through telecom infrastructure to mobile subscribers. Content services exclude product inquiries, customer support, and transaction verification.

Key provisions

1.     Subscriber consent and registration confirmation: Content services with periodic charges (daily, weekly, monthly, etc.) can only be provided after users explicitly agree to the service and receive a confirmation message. Notifications can be sent via SMS or other methods.

The notification must include: Confirmation of successful registration, Name of the service, Telecom code or number used for the service, Billing cycle and charges, Cancellation instructions, Support hotline

2.     Monthly notifications

On the 25th of each month, telecom providers must send users a message listing: The content services they are subscribed to, The package name, Service charges and

User control and protection: Providers must offer tools for users to review their transaction history, including charges for up to 180 days from the registration date. Upon a cancellation request, users must immediately receive a confirmation message.

Decree 147 introduces additional responsibilities for mobile telecom providers:

1.     Ensuring compliance: Providers must ensure that all connected content services comply with legal requirements.

2.     Suspending or terminating connections:

Telecom providers must temporarily or permanently disconnect services in the following cases: If content providers violate the law or receive warnings or complaints about illegal content. When directed by a competent authority, with implementation required within 24 hours. If the content provider’s registration certificate, telecom codes, or numbers are suspended or revoked.

3.     System management: Providers must maintain oversight of all processes, including service registration, authentication, renewal rejection, and cancellation, ensuring strict compliance with Decree 147.

Decree 147/2024/NĐ-CP will take effect on December 25, 2024.
