VietNamNet Bridge – After VietNamNet published information about engineer Le Van Tach’s lawsuit against Toyota Vietnam (TMV), this company has made some feedbacks about the case.

TMV’s Deputy General Director, Dang Thu Huong, confirmed that Tach’s case was dealt under Vietnam’s rules.

She said that Tach violated articles 56.4 and 57.6 of TMV’s labor regulations. TMV’s evidences show that Tach committed three violations: using TMV’s assets for personal purposes, affecting others’ tasks and disturbing others by claims, offending or unacceptable acts.

According to TMV’s representative, based on Tach’s violation and the agreement of the firm’s trade union, Tach was penalized by being arranged with a lower-paid job for up to six months.

TMV said that this is a necessary measure that it must do to ensure labor order and discipline in the company.

Lawyer Phan Van Tat, from the An Phat Pham Law Office, said that considering related evidences, engineer Tach has grounds to defend his legitimate rights and interests.

On September 14, Tach told VietNamNet that he had lodged complaint against TMV, for violating mail privacy and right of antecedents, and another complaint on a labor dispute to the People’s Court of Phuc Yen town, Vinh Phuc province, where Toyota Vietnam’s factory is based.

In addition, Tach had petitioned the police bureau of Phuc Yen town to prosecute the TMV general director and some of his inferiors for taking abuse of their position to violate his mail privacy.

Tach has alleged that TMV took such unfair action against him just because he had exposed technical faults in its cars in April.

According to Tach, TMV broke the labor laws when it transferred him to a lower-paid job, just because Tach had sent petitions to the firm’s general director three times. Tach asked the court to force TMV to annul the above decision and publicly apologize to him.

The engineer said that TMV checked his mail box at prtachlv@toyotavn.com.vn and read his personal emails without his permission. Tach said the above act is the violation of his privacy, stipulated by Article 38, the Civil Code.

TMV said that the email address given to Tach by the company is its asset and it has the right of control over it, and that employees are not allowed to use their company e-mail accounts for personal purposes. Under the company’s confidentiality policy, the employer has the right to manage and use its internal email addresses.

According to TMV, Tach used this email account for personal use and that act is considered as violating the labor rules.

Tach also accused TMV’s general director of slander. According to Tach, the general director spread unverified information about Tach’s personal life, such as he wrote tens of love letters for women and having extramarital relations since 2009.

Tach said that such information has stirred up serious misunderstandings and conflicts in his family, and the relationships between him and his wife may break up.

However, TMV confirmed that it has never made public information about Tach’s personal relations inside and outside the company.
