On the evening of September 8, a representative from the Traffic Police Department (C08) confirmed that the Ministry is preparing regulations to offer monetary support for verifiable traffic violation reports. The support applies to reports involving violations on roads, railways, and inland waterways.
The proposed circular outlines that only reports leading to administrative penalties, as defined by relevant government decrees on traffic law enforcement, will qualify for the support.
Eligibility criteria for traffic violation reports
To be eligible for financial support, reports must meet strict conditions:
Reports must be in the form of dynamic visual data (videos), with or without audio, recorded directly by the individual or organization using handheld electronic devices or devices mounted on vehicles. However, data from officially installed vehicle surveillance systems (as per transportation safety laws) will not qualify.
The footage must be submitted through officially approved channels and must not infringe upon individuals' legal rights such as privacy, dignity, or personal data.
Additionally, the footage must be recorded in public areas not already covered by government-installed surveillance systems or patrolled by traffic police.
The information must be original, unedited, and clearly show the type of vehicle, license plate or registration number (in the case of trains or boats), and the exact time and location of the violation. Duplicate reports or incidents already reported through media or other individuals will not be considered.
Reports must also comply with Clause 1, Article 17 of Government Decree No. 135/2021/ND-CP, which governs the management and use of technical equipment and procedures for gathering and using data submitted by private citizens to detect administrative violations.
Once a report is verified and leads to a decision to impose a fine, the reporting party is eligible to receive the proposed support, provided they also comply with Clauses 2 and 3 of Article 16 in the same decree.
To receive the reward, individuals or organizations must either provide bank account details or visit the relevant police office in person.
Proposed payout amounts for verified reports
Under the proposed guidelines, support levels are calculated as a percentage of the total administrative fine:
If the fine is less than 30 million VND (about USD 1,200) for individuals, or less than 60 million VND (about USD 2,400) for organizations, the reward is 5% of the fine amount, capped at 2.5 million VND (approximately USD 100).
If the fine is 30 million VND or more for individuals, or 60 million VND or more for organizations, the reward increases to 10% of the fine, capped at 5 million VND (around USD 200).
These payments are calculated based on the actual fine collected for the specific violation reported. Within 30 days of issuing the penalty, the authorized officer must process and distribute the reward to the report provider.
