The decree, 147/2024/ND-CP, issued on November 9, outlines new regulations for managing, providing, and using Internet services and online information.
The law will take effect on December 25, imposing stricter compliance requirements on foreign service providers.
Foreign organizations, businesses, and individuals providing services in Vietnam are now obligated to:
Remove unlawful content, services, or applications no later than 24 hours after receiving written or electronic requests from the Ministry of Information and Communications (MIC), the Ministry of Public Security, or other authorized entities.
Suspend accounts, community pages, or groups that repeatedly post unlawful content. Platforms must temporarily block access to accounts for Vietnamese users within 24 hours if there are at least five violations within 30 days or ten violations within 90 days.
Implement temporary suspensions for durations of 7 to 30 days, depending on the severity of repeated violations.
Accounts, pages, or content channels that violate national security laws or face three or more temporary suspensions will be permanently blocked upon request from competent authorities.
Content infringing on Vietnam’s national security must be removed within 24 hours. Failure to comply will result in technical measures to block all violating content and administrative penalties for the offending platform. Such restrictions will only be lifted after violations are addressed.
A representative of a major cross-border service provider told VietNamNet that platforms are prepared to comply with these requirements. They emphasized that upon confirmation from authorities, any unlawful content would be removed immediately in accordance with Vietnamese law.
Additionally, platforms plan to enforce community standards and local regulations by removing violating content and suspending accounts involved in serious breaches.
