The National Assembly on December 10 voted to pass the Law Amending and Supplementing a Number of Articles of the Law on Anti-Corruption. The Law takes effect on July 1, 2026.

The Law stipulates that assets and income subject to declaration include: land use rights, houses, construction works and other assets attached to the land, houses, and construction works; precious metals, gemstones, money, valuable papers, and other assets where each type of asset has a value of VND150 million or more; assets and accounts abroad; and total income between two declarations.

Compared to the current law, the declared value threshold has increased from VND50 million to VND150 million. The asset and income value subject to declaration of VND150 million applies to three declaration methods (first declaration, annual declaration, and declaration serving personnel work).

Along with increasing the value threshold, the law also raises the requirement for declaring changes in assets and income during the year from VND300 million to VND1 billion.

Additional declarations must be completed before December 31 of the year in which the asset or income changes occur. The asset and income control agency monitors changes through analysis and evaluation of the declaration or from other information sources.

If changes of 1 billion VND or more are detected but not declared, the control agency will request the individual to provide or update relevant information. If the asset or income increases, the individual must explain the increased asset origin.

The government will detail the criteria for selecting individuals subject to verification and the procedures for building, approving, and implementing annual asset and income verification plans.

Asset declaration and explanations of increased assets or income will be part of performance evaluation criteria for officials, public employees, and civil servants.

Additional agencies for asset and income control

Regarding asset and income control agencies, the Law adds regulations about the authority to control assets and income of the Inspection Commission, the National Assembly Office, and the Central Committee Agency of the Vietnam Fatherland Front.

The Government Inspectorate controls the assets and income of the declaring person who holds the position from Vice Director General (of a Department) and equivalent or higher working at ministries, ministerial-level agencies, agencies under the Government, and other agencies, units, and organizations established by the Government or the Prime Minister; and the head, or deputy head working at an organization established or approved for operation charter by the Government or the Prime Minister.

The Government Inspectorate also controls the assets and income of the Chairman, Vice Chairman of the Board of Directors, Chairman, Vice Chairman of the Member Council, General Director, Deputy General Director, member of the Board of Directors, member of the Member Council, Head of the Supervisory Board, and Chief Accountant of state-owned enterprises.

Ministries, ministerial-level agencies, and agencies under the Government control the assets and income of the declaring person working at agencies, organizations, units, and state-owned enterprises under their management, except for cases under the authority of the Government Inspectorate and the Inspection Commission.

The National Assembly Office controls the assets and income of the declaring person under its management and the agencies of the National Assembly, except for cases under the authority of the Inspection Commission.

The Supreme People's Court, the Supreme People's Procuracy, the State Audit Office, and the Presidential Office control the assets and income of the declaring person under their management, except for cases under the authority of the Inspection Commission.

The Central Committee Agency of the Vietnam Fatherland Front controls the assets and income of the declaring person under its management and the central political-social organizations, except for cases under the authority of the Inspection Commission.

The Provincial/City Inspectorate controls the assets and income of the declaring person working at state’s agencies, organizations, units, state-owned enterprises, and representatives of state capital at enterprises under the management authority of the local government, except for cases under the authority of the Inspection Commission.

The Government shall regulate the asset and income control agency for declaring persons not falling into the above cases.

Before the National Assembly passed the Law, General Inspector of the Government Doan Hong Phong stated that during discussion sessions, National Assembly deputies had opinions on the set of criteria for evaluating anti-corruption work; the types of assets subject to declaration, and the process for verifying assets and income.

The Government will provide specific regulations in the decrees detailing and guiding the implementation of the Law.
