At the seminar on the amended Labor Code and international commitments on labor of Vietnam held by the Ministry of Labor, War Invalids and Social Affairs (MoLISA) in coordination with the International Labor Organization (ILO) on September 27, Mr. Nguyen Van Binh, Deputy Director of the Legal Department under the MoLISA said the content of labor commitment in Vietnam Free Trade Agreement with the European Union (EVFTA) aims to ensure a fair competitive environment between parties in trade relations. Therefore, all parties must comply with this commitment.
Vietnam is gradually internalizing international labor standards to comply with its labor commitment, many regulations will change. The approach to labor commitment will be based on national laws and the revised Labor Code will adjust some provisions to be more in line with international labor standards.
Currently the provisions on forced labor, child labor, acceptable technical labor standards regarding working time, rest time, minimum wage, safety and hygiene In the case of labor, the Labor Code is basically in accordance with the relevant international labor standards.
This amendment and supplement this time is adjusted to better suit the practical situation of Vietnam. There are two areas of principle of equality, non-discrimination and freedom of association, collective bargaining that will be prescribed to comply with Vietnam's labor commitment in free trade agreements. new generation.
Regarding the contents of EVFTA's labor commitment, Mr. Nguyen Van Binh said: “The specific standards have not been set but only reaffirmed respect, promotion and effective implementation of 4 standards. basic labor under the ILO 1998 Declaration includes: freedom of association and collective bargaining; eliminate forced labor; eliminate child labor; eliminate forms of labor discrimination ”.
In addition, Vietnam will effectively implement the law and practice of ratified ILO Conventions; do not violate basic labor standards to give a competitive advantage and do not use basic labor standards for commercial protection purposes.
According to Andrea Prince - chief advisor of the ILO New Labor Framework Project, countries need to gradually change their awareness of the application of international labor standards, because ratifying the Conventions make an international agreement on basic labor rights; lay the minimum foundation for fair competition at the national and international level; create an international framework to ensure global economic growth benefits everyone; ensure the health, welfare and voice of workers, create conditions for employees to demand other legitimate needs.
