The Politburo approved the core contents of the proposal titled “Strengthening Intellectual Property Work to Support Socio-Economic Development in the New Context.”
According to the conclusion, intellectual property must be recognized as a strategic national resource and a critical driver of competitiveness, sustainable growth and the country's future development.
The Politburo emphasized the need to move beyond a purely administrative approach to intellectual property management and instead build a comprehensive intellectual property ecosystem that encourages innovation, commercialization and protection of intellectual assets.
The conclusion calls for intellectual property to become an integral component of national development strategies, including strategies for science, technology and innovation, strategic industries and high-quality human resource development.
It also stresses the importance of building a culture that respects creativity and protects intellectual property rights throughout society.
“Acts that infringe intellectual property rights, including the use of pirated software, plagiarism in academic activities and violations related to copyright, patents and industrial designs, must be firmly criticized and strictly handled,” the conclusion states.
Adapting intellectual property policy to the digital economy
The Politburo assigned relevant authorities to continue improving Vietnam’s intellectual property framework to ensure it is modern, synchronized and capable of adapting to the digital economy.
The conclusion calls for a comprehensive review and amendment of intellectual property laws in line with advanced international standards and the needs of emerging economic models.
Particular attention should be paid to challenges arising from artificial intelligence, big data, digital assets, biotechnology, semiconductors, digital platforms and cyberspace.
The Politburo also highlighted the need to improve intellectual property protection mechanisms in the digital environment, especially as artificial intelligence technologies develop rapidly and create increasingly complex enforcement challenges.
Authorities were instructed to strengthen sanctions against violations and study the establishment of specialized judicial mechanisms for intellectual property disputes.
Alongside efforts to develop markets for intellectual property rights and promote commercialization of research outcomes, the conclusion emphasizes the need to improve the practical application of scientific research in production, business activities and social life.
Research outcomes should be more closely aligned with market demand and the country’s development objectives.
The Politburo also called for improvements to intellectual property valuation mechanisms and encouraged enterprises to adopt long-term business strategies, increase investment in research and development and strengthen their intellectual property capabilities to support sustainable growth.
Ending unauthorized use of intellectual property
The Politburo directed authorities to develop a national program on intellectual property development and strengthen both enforcement and protection mechanisms.
It also called for adequate resources to be allocated to intellectual property registration and enforcement agencies, while enhancing the capacity of specialized intellectual property courts.
Law enforcement agencies, customs authorities, market surveillance forces, prosecutors, courts and other relevant institutions were instructed to strengthen coordination in combating intellectual property infringement, particularly violations committed in digital environments.
The conclusion specifically calls for decisive action to end the unauthorized use of intellectual property rights.
At the same time, authorities must maintain a balance between protecting intellectual property rights and ensuring access to knowledge, scientific advancement, technological development and broader social interests.
The Politburo further stressed the importance of safeguarding national security in areas related to technology, data and trade secrets, while remaining consistent with international practices and protecting national interests during international integration.
The conclusion also calls for stronger efforts to counter misinformation and incorrect viewpoints related to intellectual property issues.
Deepening international integration
The Politburo emphasized the importance of expanding international cooperation in intellectual property in a selective and strategic manner to support an independent and self-reliant economy.
Vietnam is expected to proactively fulfill commitments under international treaties and intellectual property obligations to which it is a party, while ensuring sufficient resources for implementation.
The Politburo assigned the Party Committee of the National Assembly to review and further improve intellectual property legislation while strengthening oversight activities.
Meanwhile, the Government Party Committee was tasked with developing implementation plans, coordinating with the National Assembly Party Committee to institutionalize the policies outlined in the conclusion and ensuring sufficient resources are available for execution.
